When a Virginia DUI Becomes a Felony
Most DUI charges in Virginia are misdemeanors, but three distinct circumstances push a charge into felony territory. Two arise directly under Virginia Code 18.2-270. A third DUI conviction within a 10-year period is charged as a Class 6 felony. Anyone previously convicted of a felony DUI, or of a related serious offense such as involuntary manslaughter or maiming, faces automatic felony status on any subsequent DUI conviction. The third circumstance stands apart from these repeat-offense provisions: when a DUI causes the death or serious bodily injury of another person, the driver can face a separate felony charge under Virginia law regardless of prior offenses.
Class 6 is the lowest felony classification in Virginia, but that distinction matters very little in practice. It still means state prison, a permanent criminal record, and consequences that follow a person far longer than any misdemeanor would.
Mandatory Penalties for a Felony DUI Conviction
Virginia law sets mandatory minimums that bind the sentencing judge once a felony DUI conviction is entered. There is no authority to reduce or suspend them.
Third-offense penalties (within 10 years):
- Mandatory minimum of 90 days in jail, rising to six months if all three convictions occurred within five years
- Mandatory minimum fine of $1,000, up to $2,500
- Indefinite license revocation
Fourth or subsequent offense (within 10 years):
- Mandatory minimum of one year in prison
- Mandatory minimum fine of $1,000
Vehicle forfeiture is an additional consequence. When the vehicle is solely owned and operated by the person charged, Virginia law authorizes seizure and forfeiture of that vehicle on a felony DUI offense.

A felony DUI case in Fairfax begins in the Fairfax County General District Court, where a judge holds a preliminary hearing to determine whether probable cause exists to proceed. If probable cause is found, the case is certified to a grand jury. An indictment sends the matter to the Fairfax County Circuit Court, which holds jurisdiction over all felony trials.
