How Virginia Defines Drug DUI

Virginia Code § 18.2-266 prohibits driving under the influence of a narcotic drug or another self-administered intoxicant when impairment affects the ability to drive safely. The law also covers the combined influence of alcohol and a drug when that combination affects safe driving. A drug DUI allegation therefore doesn’t require evidence of alcohol use.

Virginia also establishes per se limits, meaning specified blood concentrations can establish a statutory violation without separate proof of impairment. The listed concentrations, measured in milligrams per liter (mg/L), are:

• Cocaine: 0.02 mg/L
• Methamphetamine: 0.1 mg/L
• PCP: 0.01 mg/L
• MDMA: 0.1 mg/L

Cannabis and cannabis metabolites aren’t included among Virginia’s per se drug concentrations. A marijuana DUI allegation instead proceeds under the general standard of whether the substance affected the person’s ability to drive safely. Prescription medication can also support an allegation when the prosecution claims it caused impairment, even if the medication was lawfully prescribed.

Blood Tests & Other Evidence of Drug Impairment

Drug DUI investigations commonly use blood testing because breath tests don’t identify drugs in the same way they measure alcohol. A blood result doesn’t necessarily establish impairment, especially for substances without a per se concentration under Virginia law.

Investigators may also rely on:

• Police or witness observations
• The driver’s appearance and behavior
• An alleged smell of drugs
• Performance on field sobriety tests

Drug DUI Penalties & Testing Refusal

A first DUI offense in Virginia is a Class 1 misdemeanor. It carries up to 12 months in jail, a fine of $250 to $2,500, and a one-year license suspension. Virginia also requires installation of an ignition interlock device for a DUI conviction.

A third DUI offense within 10 years of the first is a Class 6 felony. General statutory consequences include one to five years in prison, a mandatory minimum fine of $1,000, a maximum fine of $2,500, and possible seizure and forfeiture of the vehicle. The consequences in an individual case depend on the charge, record, evidence, and applicable sentencing provisions.

Virginia’s implied consent law generally provides that a driver arrested for DUI within three hours of the alleged offense is deemed to have consented to blood or breath testing for alcohol or drug content. This rule connects the privilege of driving with post-arrest chemical testing under qualifying circumstances.

A first refusal is a separate civil offense carrying a 12-month license suspension, though a defendant may petition the court for a restricted license. A second or subsequent refusal within 10 years is a Class 1 misdemeanor and carries a three-year license revocation. Refusal allegations and the underlying drug DUI charge are distinct issues, so both require analysis when they arise from the same arrest.
