A 65-year-old male motorist was recently arrested for alleged drunk driving in Paijnter, Virginia. Police claimed he smashed his 1986 Ford pickup truck into a utility pole after veering off the road. He was also charged with driving with a revoked license. He had previously served a prison sentence on charges arising out of an earlier DUI accident in which a Virginia state trooper and his son were killed.
While police claimed he was intoxicated in the recent accident, the results of a blood alcohol test have not yet been received. His earlier conviction resulted in a ten-year prison sentence for involuntary manslaughter. His blood alcohol level during that earlier accident was reported as over twice the legal limit. A 35-year-old state trooper and his 9-year-old son died of injuries several days after that accident, which involved the motorist’s truck hitting a vehicle stopped at a red light at an intersection in Onley, Virginia. That collision started a chain of events that caused the two deaths.
At the time of that accident, the state trooper was in a car driven by his wife and accompanied by his son as the family traveled to a bookstore to attend an event surrounding the release of a then-new Harry Potter book.
A prior conviction can lead to an enhanced sentence for a second or subsequent DUI conviction. DUI convictions can result in serious consequences, including fines, prison sentences, loss of driving privileges and often loss of employment or difficulty finding new employment, particularly if a job requires driving.
If you are facing such charges in a similar incident, you should consider retaining an experienced criminal defense attorney at the earliest possible time in order to explore every possible legal defense or method of mitigating the charges.
