Explaining Grand Larceny Vs. Petty Larceny In Virginia

If you were arrested for a theft crime in Fairfax or the surrounding areas, you could be charged with either petty larceny or grand larceny. Under Virginia law, petty larceny is stealing something worth less than $1,000 and is usually a misdemeanor. If the value of the property was $1,000 or more, the theft will be charged as grand larceny. Grand larceny is a felony theft crime. A mugging, purse snatching or theft of property from a person is also grand larceny, if the property stolen is valued at $5 or more.

What Are The Possible Sentences If Convicted Of Larceny?

Petty larceny (also referred to as petit larceny in Virginia) is a class 1 misdemeanor and the maximum sentence is 12 months in jail and a $2,500 fine. Grand larceny is a felony punishable by up to 20 years in prison.

Is There Some Way To Avoid Going To Jail?

Of course, if you are acquitted (found “not guilty”), you will not face any consequences. If you are facing charges of shoplifting or petty theft, your criminal defense attorney may be able to negotiate a plea agreement that allows you to avoid jail time. In some cases, restitution, community service and other alternative sentences may be available.
