What does drug paraphernalia mean?

|

Thinking of drug charges likely brings to mind images of drugs that are illegal. Those charges do make up the majority of the drug charges that are placed; however, charges for items relate to drugs are also possible. Drug paraphernalia charges are also serious charges that can lead to severe penalties.

What is drug paraphernalia?

Drug paraphernalia is any item that is used to manufacture, package, sell, or use drugs. Some of these are normal household items that are considered drug paraphernalia because of how they are being used. Other items that are classified as drug paraphernalia are used almost solely for drug related purposes.

What are some examples of things that might be considered drug paraphernalia?

Some items, such as bongs, pipes, and hookahs are commonly considered drug paraphernalia. There are instances in which these items might be used for smoking tobacco. If that is the case, these devices wouldn’t be considered drug paraphernalia. Items, such as scales, small baggies, or spoons might be considered drug paraphernalia if they are found near drugs or in an area in which drugs are a known issue.

Are there defense options for these charges?

It is possible to present a defense to drug paraphernalia charges. One possible defense is showing that the item that is being classified as drug paraphernalia was used for legal purposes instead of illegal purposes. If you are facing drug paraphernalia charges, you should explore any possible defense options that are available to you so that you can determine which one you are most comfortable using.
