What Is Embezzlement? 

Embezzlement is a type of white-collar crime, meaning it is non-violent and involves fraudulent activities and/or corruption. Embezzlement is defined as the intentional misappropriation of money or funds with which one has been trusted or which belong to one’s employer. Because embezzlement often involves someone taking funds that do not belong to them for their own personal gain, it is often considered a type of theft crime. 

Some examples of embezzlement include: 

  • Taking donations or money from fundraising events meant to benefit a company or cause
  • Illegally taking money from a company through its payroll 
  • Siphoning money from a cash register by voiding or failing to input transactions
  • Making a series of fraudulent deposits and withdrawals with different banks 
  • Falsifying records or changing the allocation of funds to cover up stealing from an entity 
  • Accepting kickbacks from vendors or suppliers and/or inflating prices 
  • Falsifying timecards or other records of hours worked to receive extra or overtime pay

It’s important to note that embezzlement is a different crime than employee theft. With embezzlement, the defendant had their employer’s permission to handle company funds or property but took these funds or properties for personal use without the company’s permission. With employee theft, the defendant typically does not have the company’s permission to handle funds or property beyond a certain, often very limited scope. 

How Is Embezzlement Charged in Virginia? 

In Virginia, embezzlement may be charged as either a misdemeanor or a felony, depending on the circumstances. When the amount embezzled is less than $1,000, the defendant will face misdemeanor charges. This can result in up to one year in jail and fines up to $2,500, as well as additional penalties, such as restitution. 

When the amount embezzled exceeds $1,000 in value, the defendant will be charged with felony embezzlement. Felonies carry much harsher penalties than misdemeanors; a conviction for felony embezzlement in Virginia can result in a prison sentence of up to 20 years, $2,500 in fines, and restitution to the victim(s).
